SESA files friend of the court brief in FOMB’s suit to stop net metering

The Puerto Rico Solar and Storage Association (SESA) filed a friend of the court brief in U.S. District Court Wednesday in the case the Financial Oversight and Management Board filed against the government to annul Act 10-2024 that extends net metering until 2030.


The FOMB filed a suit earlier this year seeking to invalidate Act 10-2-24 (Act 10), a law designed to promote net metering. Act 10 would stop the Puerto Rico Energy Bureau (PREB) from changing the current net metering and energy distribution policy until at least 2031.


The net metering law compensates solar-equipped households for their contributions to the grid.


The friend of the court brief supports the Government of Puerto Rico and the Senate in opposing the FOMB’s motion for summary judgment that seeks to annul the law.


Javier Rúa Jovet, director of Public Policy at SESA, indicated that this appeal presents to Judge Laura Taylor Swain “data on the importance of net metering for energy resilience, especially for low- and moderate-income populations, and for the sustainable economic development of Puerto Rico.”


“The FOMB’s lawsuit is an arbitrary attack on net metering and lacks legitimate reasons. This policy allows affordable access to solar energy, benefiting Puerto Ricans and promoting the Island’s energy stability,” said Rúa Jovet in a written statement.


Entities that signed the appeal include the Solar Energy Industries Association (SEIA), GRID Alternatives, Power Solar, SolarEdge and SMA, among other organizations and companies in the sector.
