Ponce assemblyman José A. Hernández Lázaro, a candidate for the District 24 seat in the island House of Representatives, sued the Municipality of Ponce for denying his request for public information regarding the intention to declare 32 properties as public nuisances, according to a statement Wednesday.
The request for public information, covered under Law 141-2019, sought the production of documents related to the 32 properties and the process related to the contract for legal services and consulting for the public nuisance program.
“The Municipality has refused to provide the requested information under the erroneous premise that, as a municipal legislator, I cannot use the mechanisms provided under Law 141,” Hernández Lázaro said. “Beyond being incorrect in law, this position is surprising when one takes into consideration that this is the 11th time that I have used this mechanism against the Municipality during these four years.”
The submitted request seeks to investigate the processes for identifying the 32 properties intended to be declared public nuisances, with the understanding that not all of them would meet the requirements established by the municipal regulations.
“During these four years, I have insisted on addressing the problem of public nuisances, especially in light of the fires that occurred in the urban area,” Hernández Lázaro noted. “However, given the doubts that arise from this first attempt in four years to declare public nuisances, it is necessary to provide the necessary information to guarantee the transparency of the processes.”
The Citizen Victory Movement candidate added that the MVC, as it is known by its initials in Spanish, will always advocate for total transparency. The Municipality of Ponce must deliver the documents requested by the municipal legislator, he said, according to the established law.
